How to Avoid Property Lawyer Scams in Marbella
Property fraud on the Costa del Sol has made headlines again recently — including cases involving people posing as lawyers or legal intermediaries. Here's what to check before you trust anyone with your money or your signature.

Why This Matters Right Now
Cases of impersonation and property fraud are not rare on the Costa del Sol. Reported incidents have included individuals posing as lawyers or legal intermediaries to gain trust with buyers and estate agents, and cases of forged powers of attorney used to transfer ownership of properties without the real owner's knowledge. These aren't distant risks — they've affected real buyers and owners in the Marbella area.
How to Verify a Lawyer Is Real
The checks below take very little time and can be done before you share any documents or transfer any money.
- 01
Confirm bar registration directly
Ask for the lawyer's colegiado (bar registration) number and verify it directly with the relevant Colegio de Abogados. Don't rely on a business card or a website claim alone — registration status can be checked independently and quickly.
- 02
Confirm independence
A lawyer working genuinely for you should have no financial relationship with the estate agent, developer, or seller in your transaction. If the same party is recommending the lawyer and the property, treat that as a reason to ask more questions, not fewer.
- 03
Be cautious of urgency
Pressure to transfer money quickly — especially in cash, or to an account that doesn't match the firm's official details — is a common thread in reported cases. A genuine lawyer will not object to you taking time to verify who they are.
- 04
Verify any power of attorney independently
If a transaction involves a power of attorney, particularly one signed abroad, confirm its authenticity through the notary or your own independent lawyer before relying on it. Forged powers of attorney have been used to transfer ownership without the real owner's knowledge.

This doesn't replace your own diligence — always verify credentials directly and independently, especially before transferring any funds.
If You're Uncertain
If you're ever unsure whether someone claiming to be a lawyer is genuine, you can verify their registration directly with the Málaga Bar Association (Colegio de Abogados de Málaga), independent of anything you're told by the person themselves, an agent, or a developer.
