Buying Off-Plan Property in Marbella
Off-plan buyers pay in stages for something not yet finished, which makes contract terms, payment guarantees and delivery obligations especially important.

Areas typically reviewed include the developer's position, how staged payments are protected, specifications and completion dates, and what happens if delivery is delayed.
What Is Typically Reviewed
- The developer's position — their track record, financial standing and legal structure
- Payment protection — how staged payments are safeguarded, commonly through a bank guarantee or insurance covering amounts paid before completion
- Specifications — what is contractually guaranteed in terms of finishes, materials and layout
- Completion dates — the agreed delivery date and what constitutes an acceptable delay
- Consequences of delay — what happens, and what buyers are entitled to, if delivery is significantly delayed
Payment protection is a particular focus for off-plan purchases in Spain, since buyers are paying before the property exists. For how these terms are typically documented, see Private Purchase Contracts Explained.
This is one of several routes into the Marbella market. See Buying Property in Marbella for how off-plan compares to a resale purchase.
